TERMS AND CONDITIONS
1. General
- “Subversity” is an exclusive brand name belonging to “Shapiro Immersive Solutions”, registered Company in Norway, Organization number 934435575.
- All rights over the Subversity brand, its images and logo, belong to Shapiro Immersive Solutions.
- Third-party use of the brand name, images, logo or any other representation of the brand must be approved in writing by Shapiro Immersive Solutions.
- Subversity will be referred to as “Service Supplier” in the rest of this document. The terms and conditions provided by the Supplier in this document should be read carefully before any use of the Suppliers’ premises, website, or equipment.
- The supplier offers access to virtual reality (VR) and/or immersive experiences of different kinds, including but not limited to the use of VR headsets for gaming, e-sport, co-work, professional capacitation, training and simulations, as well as streaming of educational and pedagogical content.
- Most of our VR experiences can be accessed individually and as part of a group. The Supplier can accommodate group sessions of up to 4 people at the same time. Larger groups must use the VR headsets and related equipment in several rounds.
- The terms and conditions presented in this document, and any contract concluded incorporating these terms and conditions, shall be governed by Norwegian law. All disputes shall be submitted to the exclusive jurisdiction of the Norwegian courts.
- The Norwegian legislation and the guidelines from the Norwegian Customer Protection Agency state that the customer bears the risk of unexpected events that hinder the use of VR room tickets and must follow the cancellation terms of the supplier.
- The Norwegian Customer Protection Agency recommends buying an insurance to reduce such risks.
- The Supplier provides a space for storing your personal items during the game that you use at your own risk. However, the Supplier will not be responsible for loss of or damage to your stored personal belongings.
- While you are on the premises of the Supplier, you must ensure to conform to the Supplier’s codes of conduct and game regulations, adopt proper standards of behaviour, and cooperate with instructions issued by the Supplier’s employees. The Supplier will not tolerate any kind of bullying or harassment towards its employees. In this event, the Supplier reserves the right to suspend the game and/or ask you to leave the premises or deny entry.
- The Supplier reserve the right to alter, close or remove details/exhibits without prior notice for technical, operational or other reasons, and that no refunds can be given in these circumstances.
2. Booking
- The person who makes a booking must be authorized to make the booking on the basis of these terms and conditions for the whole group.
- The person is responsible for making all payments due to the Supplier.
- Payments for pre-booked sessions must be transferred before the person or group arrive to the premises.
- The person who makes the booking accepts these terms on own behalf and on behalf of all game/work/learning participants in the booking.
- The person who makes the booking must be at least 18 years old.
- Your booking will be confirmed by a booking reference. The confirmation is sent to the email address which you enter/provide at the time of making your booking. It is your responsibility to check that any booking confirmation sent to you is accurate.
- You are entirely responsible for entering your details correctly in the Online Booking Form. By submitting an Online Booking Form, you warrant to the Supplier that all details supplied by you are true and accurate.
- A binding contract between you and the Supplier comes into existence when the website confirms to you the booking. The booking will still be binding for you even if you do not receive email and/or SMS due to reasons that the Supplier cannot control (for example, if your email provider sends the relevant correspondence to the spam folder).
- This contract and all matters arising out of it are governed by Norwegian law.
3. Changes and cancellations
- It is possible to cancel or transfer your booking by contacting us no later than 1 day (24 hours) before your immersive experience starts. If you contact us later, you will be required to pay 50% of the full price for the booking reference, based on its duration (in case of membership card holders), or its overall given price (in case of single entry tickets).
- The Supplier has the right to send you an invoice in this case, whether you appear to the session or not.
- If you do not show up for session but have not cancelled it before, you will be required to pay full price for the time you booked. The Supplier has the right to send you invoice in this case.
- You can change the number of participants at any time, before or after booking, up to four people per group session.
- The rules in 3.1, 3.2 and 3.3 apply, regardless of reasons for cancellations and changes.
- The same rules will apply if you make changes because of illness, disasters, or other unexpected situations.
4. Access to the game
- VR sessions are not suitable for people with mental problems or children under 8 years of age. Participation takes place at your own risk.
- Children under 14 years old must be accompanied by an adult.
- Participants under visible psychoactive influence due to drug or alcohol consumption, or participants exhibiting violent behaviour for any other reason, might be denied access to the premises without any refund.
- Individuals and groups arriving to the premises are fully responsible to any form of loss, injury (physical or mental) or death incurred during the visit. They are obliged to comply with the Supplier’s security regulations and explanations, which are given before the start of the session.
- Our premises are located at the street level and they are accessible for people using wheelchairs or other assistance.
5. Prices
- The Supplier offers packages that are composed of different use-periods, ranging from 15 to 150 minutes.
- Used minutes will be deducted from the package based on the duration of the relevant session or service.
- Minutes are calculated per person per session. It is allowed to use a membership card to pay for several persons in a single session, but minutes will be deducted per person.
- Cards cannot be used in case they are empty or do not have sufficient minutes to complete the relevant session. In such cases the supplier will ask the owner of the card to recharge it with more time.
- Users must adhere to the rules and regulations that apply to these packages, as they are detailed in the Suppliers’ internet site.
- Pckages prices and regulations can change based on the Suppliers’ changing needs or limitations.
- The supplier also offers a fix-price single-entry tickets and gift cards upon request. Single entry Prices and regulations can change based on the Suppliers’ changing needs or limitations.
- In all cases the Supplier’s standard price per participant and/or per package must be paid.
- Discounts and promotions are occasionally listed on our website. It is forbidden to combine two different discount schemes or promotion packages within a single session.
- In the event of a wrong price quotation, the Supplier has the right to correct errors in the prices as they were stated in the booking confirmation or online, thereby preventing any unintended financial losses.
6. Damage to the equipment
- It is not allowed to use physical force when using the equipment, crash into walls or each other. If you cause damage to the equipment by failing to follow the Supplier’s regulations and explanations, or if you apply physical force or crashing into walls or each other during the sessions, you must cover the full costs for the replacement of the equipment.
7. Meet-up time
- The meet-up time for any booked session is 5 minutes before the intended start time.
- If you arrive earlier, you might be asked to wait in the waiting area.
- In case of arrival later than 5 minutes before the start of the session, the overall play/use time might be reduced, depending on other booking. No refund will be given in this case.
8. Gift cards
- Prices for gift cards will be determined by the Suppliers’ representative at the time of purchase, based on the concurrent prices of the cheapest minutes package, regardless the duration of the gift card.
- If you received or purchased a gift card, you must display it when you arrive at the premises at the time of the game.
- The entire gift card must be used in a single session, unless the gift card conditions specifically mention otherwise. If you have doubt which kind of gift card you hold, approach the employees at the premises or contact us by mail in advance.
- Gift cards cannot be returned / refunded.
- Gift cards are valid for one year from the date of the purchase. Expired gift card cannot be used or redeemed.
- We do not replace gift cards that are lost.
- For orders made with gift card, the same rules for changes and cancellations apply as for other sessions. The gift card is considered redeemed if you do not arrive on time or cancel/move the order later than 24 hours from the start time of your booked session.
9. Force Majeure
- Except where otherwise expressly stated in these terms and conditions, the Supplier will not accept liability or pay any compensation where the performance of our contractual obligations is prevented or affected by “force majeure”. In these terms and conditions, “force majeure” means any event which the Supplier could not, even with all due care, foresee or avoid.
- “Force majeure” events may include war or threat of war, riot, civil strife, terrorist activity or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control.
- The Supplier will not be obliged to compensate customers if they suffer any damage or loss as a result of the instantiation of such force majeure events.
10. Personal and Financial Data Privacy
- The Supplier collects and stores your personal details without disclosing it to any third party and is dedicated to ensuring that your personal information is safeguarded.
- The Supplier requests personal information as part of the booking process. Your e-mail address and phone number are used for sending notifications related to the game booking and contacting you. Your name is used for identification purposes when you arrive to the Suppliers’ premises. Any additional information provided when making the booking is used to prepare for your visit and perform statistical analysis.
- The Supplier requests payment information online or on-site to process and secure the transfer of the requested sums of money from the user to the Supplier.
- The Supplier will only share your name and booking details with our employees for operational and logistical purposes.
- The data is held by “Shapiro Immersive Solutions”, organization number 934435575, Fognavegen 10, Fogn, 4164, Norway.
- The Supplier is using third-party vendors for handling booking and payment processes online and on-site. The booking process is handled by our online booking system and third-party suppliers.
- We handle financial transactions through our payment service providers such as Vipps. This Third Party has its own separate privacy policies. Any complaints regarding the use of the information by Vipps or any future Third Party the Supplier will hire for the purpose of data processing and/or handling financial transactions should be directed to that Third Party alone.
- The Supplier will take all appropriate steps to protect any payment information by complying with the security policies of the Third Party Vipps.
- The Supplier shall not be liable for any damages that you may suffer as a result of the loss of confidentiality of any information, person or financial.
- With your verbal consent, the Supplier will take a photo of you and/or your team after the VR session you have completed and post the photo on our website, Facebook, Instagram, Tik Tok, LinkedIn, and/or other social media outputs.
11. Website use and security
- The website http://www.subversity.org is owned by Shapiro Immersive Solutions and is operated by the Supplier. The Supplier holds the right to amend these Terms and Conditions including the content of the website from time to time at its sole discretion without prior notice.
- The terms and conditions detailed in this document apply to the use of the Suppliers’ premises and equipment by any visitor, whether the visit is to the Supplier’s website or to its physical premises.
- Based on GDPR regulations we use cookies to improve user experience, to gather information for marketing purposes and to develop our business further.
- The Supplier shall not be liable to any direct or indirect, consequential or incidental damages, including but not limited to lost profits or revenues, loss of opportunity, costs of replacement goods or services, loss or damage to data or business interruption, arising out of any use of the website or the Supplier’s physical property and/or equipment.
